User Agreement

MYTRIPPIN markets and procures offers and auction services for hotel accommodations, dining, car rentals, lifestyle, airlines, etc. For this purpose, MYTRIPPIN operates the "mytrippin.com"  internet Portal and mobile application.

Registered users of the Portal are authorized to make a bid offer or/and bid auction via the internet Portal and mobile application with the operators of the service providers. By making a bid offer and/or bid auction, registered users enter into a direct contractual relationship with these service providers (Standard Contract of Sale), and MYTRIPPIN acts solely as an intermediary between You (buyer) and the Service Providers (seller). All registered users agree to be bound by these terms when concluding a Contract of Sale. MYTRIPPIN is not a party to the Contract of Sale.

If there is a conflict between the English version of our Terms of Use and another language version, the English version prevails.

      1. Scope and definitions

1.1 The document contains the Terms and Conditions and general rules for the acquisition and use of  “MYTRIPPIN”, as well as the use of the internet Portal and mobile application.

1.2 For the purpose of these General Terms and Conditions:

  • “MYTRIPPIN/We/Us/Our” means Alpome Pte Ltd, a company incorporated under the Singapore laws having its registered address at 7 Temasek Boulevard, #12-07 Suntect Tower One, Singapore 038987.
  • “Portal” means the website, mobile application, and White Label pages operated by MYTRIPPIN on which the services and benefits are made available;
  • “Users” means collectively the individual persons registered and the Service Providers registered
  • "Member" means the individual persons registered on the Portal;
  • "Service Providers" means the providers and/or operator of the various services which are offered through the Portal;

      2. Registration, login details, and formation of the user agreements

2.1 In order to use the Portal, you are required to register and open a user account and be verified.

2.2 To register, users need to provide their email address and their name or their organisation name. The email address must belong to you or the service provider’s domain and be functional. You can also register using your social media accounts by connecting your profile and personal data associated with it with MYTRIPPIN. Users must provide accurate, current, and complete information during registration and keep the account information up-to-date. Bear in mind that entering third-party data is not permitted.

2.3 The login details (username and password) may only be used by the user. The user may not register more than one account or transfer their account to someone else. For better data protection and security, the user is strongly encouraged to activate the 2FA provided.

2.4 The user is responsible for maintaining the confidentiality and security of their account credentials and may not disclose such credentials to any third party. The user must immediately notify MYTRIPPIN if they suspect that their credentials have been lost, stolen, or their account are otherwise compromised. In such a case, we will block the account immediately as a preventative measure.

2.5 The user is responsible and liable for activities conducted through their MYTRIPPIN account unless such activities are not authorized by the user and the user is not otherwise negligent (such as failing to report the unauthorized use or loss of their credentials). 

2.6 You, as the user, are obliged to ensure that email messages from MYTRIPPIN reach you and that their delivery is not prevented by security-checking safeguards (particularly spam filters).

2.7 You are bound by the Bid and Offer made by which they are entered into the Contract of Sale.

2.8 The user agreement is concluded with the process of registration.

 

      3. MYTRIPPIN Services

3.1 The services offered by MYTRIPPIN can be accessed only by registered users; they are directed only towards a closed group of members within the context of their respective availability and the respective content. Only persons who are of legal age (at least 18 years old) and have full legal capacity (for example, the ability to independently engage in a contractual relationship or independently make decisions regarding their rights, duties, and obligations) are authorized to acquire a MYTRIPPIN login. Your MYTRIPPIN login is personal and not transferable.

3.2 Users can manage their personal details directly from the user’s account. 

3.3 Your full access to the services provided by MYTRIPPIN may begin when activated. Entitlement to the free period is determined at the sole discretion of the company. For each service rendered, you may be subjected to a participation fee / platform fee as specified in the check-out process.

3.4 In order to ensure that our MYTRIPPIN runs smoothly and is free from interference, immoral, fraudulent and unlawful behaviour and behaviour that is contrary to our Terms of Use, the following rules apply: 

a. Our instructions are binding. You will comply with any and all reasonable directions and instructions with respect to our Auctions that are given by us or on our behalf. If a situation arises that is not covered in our Terms of Use, if there is a dispute between Users, or if other irregularities arise, we will decide how to proceed. 

b. Every bid is binding. Every bid submitted in MYTRIPPIN via the automated procedure(s) provided for by us (‘Bid’) is binding and any Bids made from your Account will be deemed to have been made by you, even if the Bid is placed by someone else who uses your Account.

  1. We do not allow shill bidding. Shill bidding is when someone bids on an item to artificially increase its price, desirability, or search standing. Shill bidding can happen regardless of whether the bidder knows the Seller or vice versa. We want to maintain a fair MYTRIPPIN for all our Users, and as such, shill bidding is prohibited on MYTRIPPIN. This includes but is not limited to bidding on your own Offers and/or the Offers of someone related to you. You are also not allowed to have someone related to you bid on your Offers or to instruct someone to bid on your Offers.
  2. We may terminate your participation in MYTRIPPIN. We are entitled to temporarily suspend or permanently disable the possibility for you to bid or make an offer on MYTRIPPIN at any time (before, during, and after).

    e. We may remove a Bid/Offer from MYTRIPPIN. We are entitled, at our own discretion, to remove a Bid/Offer from MYTRIPPIN if we deem this necessary, such as in the event of possible abuse or fraud or in the event of a mistake.
  3. We may, in exceptional circumstances, dissolve a Contract of Sale. In exceptional circumstances, including but not limited to force majeure, situations of (suspected) fraud or illegal activity, errors in or outages of our MYTRIPPIN or situations in which there is a risk of serious adverse consequences for MYTRIPPIN or any of our Users, MYTRIPPIN has the right to dissolve a Contract of Sale, such without any default or other condition of formality being required. You irrevocably agree that MYTRIPPIN has this (third party) right under the Contract of Sale and that this right can be invoked against you. In addition, you hereby grant MYTRIPPIN an irrevocable power of attorney to invoke this right.

3.5 We charge a user fee for our Services. MYTRIPPIN charges a commission fee which is a combination of either a fixed fee and/or service fee of the Purchase Price (‘Seller Commission’) and Participation Fee and/or Platform Fee, (“Buyer Commission”). If applicable, the fee will be increased by VAT/GST, taxes (such as withholding taxes), customs, duties, and levies that may be due. The fee component of User Fees may increase based on demand and other factors such as type of services rendered. MYTRIPPIN will always endeavour to inform You about any such fees via the User Application and it is Your responsibility to review the User Fees (or the basis on which they will be charged) carefully before electing to purchase the Services. You will be deemed to be aware of, and You accept responsibility for, all User Fees incurred under Your Account.

 

       4. Payment

4.1 The payment may be made using the payment methods offered by MYTRIPPIN. The payment is securely processed by an external, encrypted service. Credit card details (number, expiry date, CVV) are not processed, stored, and used by MYTRIPPIN directly. 

 

       5. Term and Cancellation of MYTRIPPIN Services

5.1 MYTRIPPIN access extends perpetually until the user decides to cancel the access. The cancellation can take place anytime via the user’s personal account on the platform. Written cancellations are not accepted.

5.2 MYTRIPPIN reserves the right to charge a fee for all support and services You obtain, directly or indirectly, through the use of the System, as notified to You by MYTRIPPIN from time to time (including via the Policies).

 

       6. Liability and set-off

6.1 The details of the Service Provision on the Portal are based on the information provided to MYTRIPPIN by the Service Providers. The Service Providers are given access to MYTRIPPIN systems and extranet through which they are fully responsible for updating all rates/fees/prices, availability, policies & conditions, and other relevant information. Each Service Provider remains responsible at all times for the accuracy, completeness, and correctness of the information displayed on Portal. To the extent that this is legally possible, MYTRIPPIN is not liable for any defect in the correctness and/or completeness of the offers and/or information provided by the Service Providers.

6.2 To the extent that this is legally possible, MYTRIPPIN is specifically not liable for any inaccuracy relating to the descriptive information (including rates, availability, and ratings) of the Service Providers made available on Portal, and the services rendered or the products offered by the Service Providers or other MYTRIPPIN Partners.

6.3 MYTRIPPIN is not responsible for outages or disruptions of the Internet and telecommunications infrastructure which are beyond our control and can lead to interruptions in the availability of the Portal. 

6.4 To the extent that this is legally possible, claims for damages on whatever legal basis (including but not limited to claims due to breach of duty and from illicit acts, as well as claims for compensation of futile expenditures), are excluded vis-à-vis MYTRIPPIN, as well as its legal agents and vicarious agents unless the damage was caused intentionally or by gross negligence.

6.5 To the extent that this is legally possible, neither MYTRIPPIN nor any of its agents, officers, directors, employees, representatives, subsidiaries, affiliated companies shall be liable for any punitive, special, indirect, or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim unless the damage was caused intentionally or by gross negligence.

6.6 To the extent that this is legally possible, the user may not claim compensation for damages as a consequence of a challenge due to non-culpable errors and printing, advertising, or transmission errors, which authorize MYTRIPPIN to challenge.

6.7 To the extent that this is legally possible, and without prejudice to clauses 6.1. to 6.6. MYTRIPPIN shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of the service that you have purchased.

 

       7. Amendments to the General Terms and Conditions

7.1 MYTRIPPIN reserves the right to amend these General Terms and Conditions at any time and without reason. In case of amendments, the new General Terms and Conditions will be sent to you by email. The new General Terms and Conditions are deemed as accepted if you do not object to their validity within 14 days after receipt of the email. In the email, we will inform you about the option to object, the time limit, and the consequences of your inaction. The objection must be issued in written form.

7.2 However, the option of amending the General Terms and Conditions does not apply to changes that impair the content and scope of the core utilization options of MYTRIPPIN and the Portal to your disadvantage, nor to the introduction of new obligations for you, which were not previously established in the General Terms and Conditions.

 

       8. Privacy

       9. Force Majeure

9.1 MYTRIPPIN shall not be liable for any delay or failure to perform resulting from circumstances (force majeure events) beyond the control of MYTRIPPIN whose performance is being affected, including but not limited to natural disasters, epidemics, governmental or regulatory actions or restrictions, sanctions, embargoes, hostilities of any kind, wars, civil wars, terrorist acts, riots, insurrections, nuclear incidents, EMP, essential utility failure, etc. 

 

       10. Jurisdiction

10.1 The contractual relationship with you is governed exclusively by Singapore law.

10.2 Any dispute arising out of these Terms and Conditions shall exclusively be submitted to the competent courts in Singapore.
